Data Protection Policy
a) Fusion Estate Management Limited (“Fusion”) is registered as both a Data Controller and Data Processor under the Data Protection Act, No. 24 of 2019. Fusion collects only necessary personal data of clients who commit to purchasing any of their properties or leasing any of their premises for purposes of fulfilling all legal and contractual obligations arising from such sales or leases.
b) As a data subject you are entitled to access your personal data in our custody, or request for it to be corrected or deleted where false or misleading. You are also entitled to object to the processing of all or part of your personal data – however, please note that such an objection will lead to the immediate termination of all contractual obligations between Fusion and yourself as such personal data is mandatorily required by law to ascertain your identity as Purchaser and for inclusion in all legal agreements and documents necessary to effect the sale/transfer.
c) Your personal data will not be transferred to any third parties outside of Fusion. Nonetheless, some parties involved in the sale in various legal capacities shall come into possession some of your personal data contained in legal documentation e.g. Fusion’s advocates, the bank (for
payment of the Purchase Price) and the Lands Registry.
Where any transfer to third parties shall be necessary, Fusion will seek your consent.
d) Fusion endeavours to protect all personal data to the highest level of security possible to prevent any data breaches. These include but are not limited to secure physical and digital repositories with only authorised access.
e) By submitting this form, you consent to having your personal data collected and processed by Fusion for the purposes and in the manners outlined in the above preceding clauses, and to be held by Fusion for the durations required by law.
Terms & Conditions
This reservation is subject to availability of parcels at the stated price at the time of receipt of the Reservation Fee in cleared funds.
- If the Reservation Fee stated is paid in a foreign currency, it shall be held in the said currency, and shall only be converted to Kenya Shillings after the signing and execution of the Agreement for Sale by all parties.
- This Reservation Fee is refundable upon written demand at any time prior to signing of the
Agreement for Sale. All such refunds shall be issued in the Purchaser name(s) stated above
regardless of the source of funds. - This reservation shall be deemed confirmed only upon receipt of the required Reservation Fee in full and in cleared funds.
- This reservation is subject to contract and subject to signing of the Agreement for Sale within the stipulated timeframe.
- The Agreement for Sale for this purchase must be signed within Ten (10) days from the date of the issuance of the Agreement for Sale after which the availability and price of this property may be subject to change
